Q: I have two children one is aged 18 and the other is aged 22, can they both live permanently in the USA with us under the EB5 program?
 
A: Unfortunately all children have to be under 21 at the time that you apply for the EB5 visa. In your case the eldest child would not qualify and the only way around this problem would be to purchase a second EB5 visa in their name and pay the required fees.
 
Q: Can I live anywhere in the USA if for instance I purchased a franchise in Florida?
 
A: The beauty with the EB5 visa is that it allows you to live wherever you choose in the USA - you do not have to live where the business is situated.
 
Q: In general: my concern is that a number of Regional Centres (RC'S) are not performing &
the yearly Uscis audit will continue to grow teeth.

A: This is correct...many, if not most, RC's have problems on the front end (bad business plans and shaky economic models for indirect job creation) and back end (they are simply bad business deals that a normal investor would never make).
 
This is why AmeriPath was created to be a DIRECT investment by the immigrant. This concept follows the ORIGINAL and ESSENTIAL EB5 laws...i.e., the US wanted foreign investors to come here with $1million, open a business, and employ at least 10 people over the course of 2 years. However, foreigners didn't know where to go or what to do, so very few came to invest. Thus began the mess that is now Regional Centres as a way for Americans with knowledge of the local market to form the business and seek outside investors to fund it as long as sufficient jobs were created. 
 
So, the IDEAL method is to assist a foreigner to open his OWN 100% owned business..the original intent of EB5...and for that we get a fee. The business he'll open is a proven franchise, in fact, there are other successful franchises being sold to EB5 investors, so the concept is not novel but in fact is proven to be accepted by USCIS.
In the case of the Home Centre franchise, what makes it unique and the BEST EB5 opportunity is that not only does it EASILY create 10+ direct, actual, full time jobs (more likely at least 15), but 80% or more of the invested dollars are in a liquid, secure, renewable investment for which we can secure an annual return of 8% consistently and reliably based on 20+ years of history, and by which the investor, should he choose, can recover all or any portion of his original invested capital after he has his permanent Green Card (about 3 years after the initial investment). All other programs have the invested funds tied up in liquid assets such as bricks and mortar; thus, the only way for an investor to recover his principal is via a refinancing (unlikely), or a sale of the business (very challenging in today's market). 

 
Q: Is the Ameripath franchise system a Regional Centre and will there be difficulty as each investor is assessed.

A: It is NOT a regional Centre by any definition. Each investor will own his own LLC 100%. He can manage any aspect of the business he wants. his franchise will come pre supplied with the employees and the general manager/broker to run the day to day affairs. The owner can take over running the franchise if he wants (but that would be foolish given that he would know nothing about the local real estate market in his franchise territory). He has total control. Clearly NOTHING like any Regional Centre where the investors are all mandated to be passive and must rely totally on the Regional Centre to manage the business with all of that risk and no recourse if there is failure.

 
Q: In specifics: The Admin fee seems too high;

A: The Admin fee is consistent with a wide range of Regional Centre fees, which  generally range between $40k to $100k. The Ameripath investment is the ONLY EB5 investment that starts paying the return on DAY ONE of the investment..so the investor starts to recover his costs immediately. Over the course of the 3 years before he gets his permanent green card, the investor will have received no less than $120,000 in CASH...so if he elects to sell his interest to recover his investment, he will have gotten back his full $500k, plus a net of $50,000 in cash, plus a permanent green card.
